This article introduces a process for the preparation of obeticholic acid and discusses the status of related patent applications concerning its crystalline form. By combining the context of the key patent technology and summarizing related aspects of technology evolution and efficacy relationships, this article aims to provide beneficial references for fair patent placement, patent mining, prevention of patent infringement for imitation businesses, as well as the guidance on technological development and the strategic intellectual property considerations for domestic pharmaceutical businesses.

奥贝胆酸(obeticholic acid,商品名:Ocaliva)是由美国英特赛普特(Intercept)医药品公司研发[1],化学名称:6α-乙基-3α,7α-二羟基-5β-去氧胆酸-24-酸,分子式为C26H44O4,相对分子质量:420.63,CAS登记号为459789-99-2,化学结构见图1。2016年5月27日获得美国FDA上市批准[2],用于治疗原发性胆汁性肝硬化,是近20年来首个获批治疗原发性胆汁性肝硬化的药物。数据显示,奥贝胆酸2020年全球销售额接近26.2亿美元[3]
采用奥贝胆酸的CAS登记号在国际联机检索系统(STN)中检索全球的专利,同时用药物通用名obeticholic acid、商品名Ocaliva作为关键词在世界文摘专利库(WPABS)中,采用分类号和关键词结合的方式进行检索,与STN结果合并去重,共获得573项专利,以此作为下述分析的数据样本,检索数据截至2024年7月28日。通过分析筛选,对获得的专利总体情况、申请人分布以及原研企业的专利状态进行分析。
图2显示了奥贝胆酸的申请量趋势。大致经历了以下2个主要发展阶段:2002—2013年为萌芽期,2014年至今为发展期。随着美国、欧洲先后对奥贝胆酸批准上市,全球许多药物研发机构都对该药物给予了很大的关注,围绕着奥贝胆酸的专利申请也随之飞速上升[4]。这一阶段是奥贝胆酸相关专利的高速发展期。值得注意的是,国内发明专利申请通常自申请日起18个月才能公开,国外专利大多通过专利合作条约(patent cooperation treaty,PCT)途径进入我国,从申请到公开周期超过32个月,因而造成2022—2023年申请量数据不完整,在趋势分析中,近2年的数据未进行统计分析。
图3显示了奥贝胆酸全球专利申请人状况,其中原研公司英特赛普特医药品公司的申请量位于首位,其次是中美华世通生物医药科技(武汉)有限公司,丽珠集团新北江制药股份有限公司和中国药科大学并列第3位,华东师范大学和赞蒂瓦有限合伙公司并列第4位。可见奥贝胆酸的相关专利申请人主要为原研公司英特赛普特医药品公司。从原研公司和其余申请人的差距可以看出原研公司英特赛普特医药品公司的优势,同时也可看出我国的一些仿制药企业也在对该药物积极地开展专利布局[5]
图3可看出,原研公司英特赛普特医药品公司注重布局全球市场,对奥贝胆酸进行了全方位的专利布局,无论是在国内还是国外,其申请量均稳居第一位。因此,国内企业在进行生产和研发时,应充分考察奥贝胆酸的专利保护情况,避免专利纠纷以及研发成果不能获得专利保护。
奥贝胆酸的原研化合物专利(WO2002072598A1)是由意大利佩鲁贾大学的Pellicciari Roberto进行申请的,并陆续在欧洲、美国、日本等主要国家获得授权,其中美国专利US7138390B2拥有延长期,专利保护期到2022年11月16日。
对于奥贝胆酸原研专利,原研公司在美国提出了多次分案申请,均已授权。US7138390B2涉及奥贝胆酸的化合物、用途;US7786102B2,US8058267B2,US8377916B2,US10421772B2涉及奥贝胆酸的治疗用途;US8969330B2涉及奥贝胆酸的制备方法以及用途;US9732117B2涉及奥贝胆酸的盐形式,如钠盐、锂盐、钾盐,半钙盐等。原研公司在美国“持之以恒”地提出分案申请来获得更大的保护权益,这足以证明奥贝胆酸巨大的市场价值。
从全球的奥贝胆酸专利申请的角度看,制备方法、晶型、组合物、治疗方法4个技术分支是技术人员关注的重点领域,其中制备方法和晶型是中国专利申请以及中国仿制药企业关注的重点。因此,接下来主要对制备方法、晶型以及原研公司的专利技术进行概述和分析。奥贝胆酸全球专利申请技术构成见图4
奥贝胆酸的制备方法有多种多样,在制备方法技术路线演进的过程中,不断伴随着对工艺的优化,我国的仿制药企业对其作出了重要贡献[6]。为了充分地了解奥贝胆酸的技术改进方向,本文分析并归纳了国内外奥贝胆酸的制备方法专利。专利申请WO2002072598A1首次公开了奥贝胆酸的合成路线,以3α-羟基-7-酮基-5β-胆烷酸为起始物料,使用3,4-二氢吡喃(dihexylphthalate,DHP)处理原料,将3位羟基进行保护,而后使用二异丙基氨基锂(lithium diisopropylamide,LDA)作为夺质子碱,进攻羰基的α位,再与溴乙烷进行反应,经过脱DHP保护基、选择性还原反应、皂化反应,最终制备得到奥贝胆酸。该工艺的关键步骤需要超低温,不仅条件苛刻且转化率低,导致总收率仅为3.5%左右,此外,在制备过程中使用有毒试剂六甲基磷酰三胺(hexamethylphosphoramide,HMPA),不利于工业化生产。专利申请WO2006122977A2对上述合成工艺进行了改进,将带有三甲基硅基保护基的化合物V在强碱条件下转化为烯醇硅醚化合物VI,化合物VI经与乙醛间的Mukaiyama羟醛反应得化合物VII,化合物VII经钯碳加氢还原后差向异构化得化合物VIII,最后经过还原羰基得奥贝胆酸。专利申请CN105669811A公开了以6α-ECDCA-甲酯作为原料合成奥贝胆酸的方法,该制备方法可简化操作、构型转化率高地制备得到奥贝胆酸,并且易于纯化,后处理简单。专利申请WO2016045480A1通过对化合物V的羟基进行保护,可以避免强碱性和高温条件下发生脱水等副反应,大大提高了奥贝胆酸的合成效率。专利申请CN115385976A公开了以3α-羟基-7-氧代-5β-胆烷酸式(Ⅱ)为起始原料,经关环反应和羟基保护、乙酰化最终制备得到奥贝胆酸,所述方法原料易得、操作简单,适合工业化生产。
总结申请人对于合成工艺优化的技术手段以及技术效果,得到了如图5所示的奥贝胆酸制备方法的技术功效图。其中,对于技术手段改进的主要方向除了改变制备路线外,还包括改变原料、改变催化剂、改变溶剂和试剂以及其他手段的改进,其他手段包括合成装置的改进等。在对不同的工艺路线进行改进的过程中,申请人比较追求的效果包括:高收率、反应温和、易于后处理、纯度好、适于工业化、成本低、环境友好、工艺简单等方面。
图5可以看出,针对“制备路线的改进”的专利申请量较大。可见,从技术手段来看,奥贝胆酸的制备中对于技术手段“制备路线的改进”是较受关注的研究方向;从技术功效来看,研究相对集中在“收率高”和“纯度好”这2个方向,收率和纯度也一直是合成反应中比较关注的2个分支。
申请人对于合成工艺的改进往往涉及多个不同的技术手段,通过不断优化实现多个技术效果。从原料角度考虑,在胆酸、鹅去氧胆酸、7-氧代石胆酸中,胆酸为原料时合成线路较长,7-氧代石胆酸价格较为昂贵,鹅去氧胆酸为初始原料,合成路线不仅比胆酸简短,而且原料价格又比7-氧代石胆酸廉价[7]。综合考虑成本和实验环境要求,推荐使用鹅去氧胆酸作为起始原料。从工艺路线方面考虑,由于使用亲核加成法插入卤代乙烷的方法产率过低,立体选择性较差,而乙醛Aldol缩合法在空间构型、反应条件方面更具优势,建议使用Mukaiyama Aldol缩合反应作为插烃方法[8]
在全新的市场竞争形势下,制药企业若还想在仿制药市场中立足并获得竞争优势,降低原料药和中间体的生产成本、提高质量、减少污染是制胜法宝。生产工艺和工序改造无疑是降低生产成本、提高营业利润的一个重要环节。因此,仿制药企业同样需要构建自身在奥贝胆酸制备方法类专利中的技术壁垒,积极采用精准催化和绿色化学等方法降低成本,才能在产业链中转化为竞争优势。
2012年,英特赛普特公司对奥贝胆酸的晶型开始进行专利布局,在WO2013192097A1中公开了奥贝胆酸具有结晶奥贝胆酸A型、C型、D型、F型和G型结晶态以及奥贝胆酸1型非结晶态。2014年,苏州晶云药物科技有限公司的专利CN105801653A中公开了一种新的晶型A,其可由原研公司中公开的晶型C在乙酸乙酯和正庚烷的混合溶剂中转为晶型A。2015年,丽珠医药集团股份有限公司在专利CN105175473A中公开了一种奥贝胆酸的晶型I。赞蒂瓦有限合伙公司在专利CZ20150504A提供了2种结晶形式的高纯度的奥贝胆酸1-2和1-3。江苏奥赛康药业股份有限公司在专利CN105985395A中提供了一种奥贝胆酸晶型。2016年,拉蒂奥法姆有限责任公司在专利EP16163764A公开了奥贝胆酸和环糊精的无定型复合化合物。鲁平有限公司在专利WO2017115324A1中公开了奥贝胆酸结晶形式α,β,γ和δ。2017年,江苏恒瑞医药股份有限公司在专利CN107531744A中公开了奥贝胆酸晶型E。雷迪博士实验室有限公司在专利IN2017041016891A公开了奥贝胆酸的无定型形式。2018年,拜欧弗印度制药有限公司在专利IN2018041013461A中公开了奥贝胆酸的晶型B1,B2,B3和B4。2022年,四川弘远药业有限公司在专利CN114644670A中公开了奥贝胆酸和对氨基苯甲酸的共晶。
对于原研药企业,通过申请药物晶型专利可以延长基础专利的保护期,同时形成对仿制药企业的保护障碍。对于仿制药企业,通过研发不同的药物晶型并进行专利保护,能够绕开原研药企业的专利屏障,在仿制药市场中占得先机。苏州晶云药物科技有限公司、丽珠集团、长奥医药有限公司、四川瑞希康生物医药有限公司、江苏恒瑞医药股份有限公司等基本是在有机酯类溶剂和烷烃类溶剂中通过溶析结晶制备得到奥贝胆酸的不同晶型。四川弘远药业有限公司还开发了奥贝胆酸和对氨基苯甲酸的共晶,新共晶的产生为后续药物的结构和性质研究提供了可能,也为新产品的开发提供了更多的选择。
英特赛普特医药品公司作为原研公司在2002年以PCT申请WO2002072598A1对奥贝胆酸化合物专利进行了战略市场保护,并陆续在欧洲、日本、美国等药品主流市场获得专利授权。奥贝胆酸后续的外围专利也同样由英特赛普特医药品公司进行申请,主要布局在盐/晶型、适应证、衍生物和联合用药技术。除化合物专利外,英特赛普特医药品公司亦申请了奥贝胆酸异构体结构式专利WO2005082925A2,这些专利均没有进入中国,猜测可能是研发初期,原研公司并没有意识到奥贝胆酸具有如此优异的治疗效果,未在全球范围内进行专利布局(在日本、中国、韩国等均未进行专利申请)。直到2010年,以WO2010059859A1衍生物专利才开始在中国布局(申请号:200980154703.7),中间经历了驳回、复审等一系列曲折的过程,最终于2016年12月2日授权,2023年6月26日因未缴年费终止失效,猜测原因可能是由于该衍生物后期临床效果数据偏差,原研公司放弃了该衍生物后续的专利权保护。
从申请日来看,原研公司从2002年开始布局化合物专利到2005年申请异构体以及适应证、联合用药专利,至2009年申请衍生物专利,2013年申请晶型、制备方法、适应证专利保护。其中晶型专利WO2013192097A1相较于奥贝胆酸化合物专利而言,进行了全球化的布局,猜测是由于前期化合物专利并没有进行全球大多数国家的专利布局,当发现其具有优异的治疗效果后,退而求其次,开始进行晶型的布局。这也与前文提到2014年针对治疗原发性胆汁性胆管炎提交新药申请相呼应。该晶型专利母案目前在中国驳回失效,分案也于2023年5月16日视撤,制备方法专利WO2014066819A1已在中国授权。见表1
英特赛普特医药品公司作为原研公司对奥贝胆酸进行全方面多角度的专利布局方式值得国内企业借鉴[9]。对仿制药企业而言,从获得专利到仿制药上市的过程漫长,同样需要企业不断地进行专利挖掘和专利布局并且适时地根据企业自身特点进行调整。
通过对奥贝胆酸的专利文献进行梳理不难看出,原研公司的化合物基础专利没有在中国申请,晶型专利在中国被驳回失效,衍生物专利虽然在中国被授权,但因未缴年费而失效。虽然中国的专利申请人在奥贝胆酸的专利申请量上占据较大优势,但其核心专利仍然掌握在原研公司手中,英特赛普特医药品公司由于掌握了化合物的核心专利并进行了较为全面的布局,具有先发优势[10-11]。目前化合物专利已经失效,后续仿制药企业通过对晶型和制备工艺的改进等不同维度优化技术,补强对奥贝胆酸外围专利的布局。在制备方法方面,我国的仿制药企业占据申请量的主导,改进的关注点更集中于提高纯度和收率、适合工业化生产等;晶型的改进方面主要集中在稳定性、溶解性、高纯度等方面。希望国内申请人能够在激烈的研发中重视对专利技术的跟踪和调研,并且根据自身企业特点做好专利布局和专利挖掘,对国内制药企业来说既是机遇也是挑战。
目前,国内药企江苏恒瑞医药股份有限公司和正大天晴药业集团股份有限公司正积极布局奥贝胆酸仿制药上市,以抢占市场份额。因此,期待国内申请人在针对奥贝胆酸的仿制药等方面取得突破性进展。鉴于前文的相关数据,相信在随后的一段时间内,国内外针对奥贝胆酸的研究将进一步深入。
