在“一国两制”三法域格局下,知识产权跨域协同已成为粤港澳大湾区科技创新体系的核心议题。以“制度软对接”为视角,将知识产权理解为贯通研发供给、产业承接、资本支持与治理保障的制度枢纽,依托联合研发、港澳成果转化与平台化侵权治理场景,搭建“规则-运行-治理”分析框架。研究表明,协同梗阻不在三地差异本身,而在差异未能转译为可识别、可衔接、可预期的制度接口,遂累积为规则适用、要素流通与治理闭环上的结构性张力。化解之道分3层:规则层有赖标准互认、合同安排与指引性规则的渐进对接;运行层借助平台载体、金融工具与中介服务,将知识产权由静态权利推向流动要素;治理层须打通监管、合规与解纷节点,形成闭环。三者在软对接主线下层层嵌套,能在保留法域多样性的前提下激活功能增效,为大湾区国际科技创新中心建设提供可行路径。
