In view of the deficiencies in the spatial layout control, management policies, and regulation of sea use of far offshore wind power in China currently, this paper analyses the current situation of sea management for far offshore wind power in the domestic and overseas, through drawing on the management experience of far offshore wind power from abroad and the management practice of offshore wind power in China's near−sea, the following countermeasures and suggestions are proposed: First, on the basis of clarifying the resource and ecological background of deep sea, formulate a spatial plan for far offshore wind power, and promote the implementation of far offshore wind power in a coordinated manner. Second, study on the management policies of far offshore wind power, such as approval for sea use, development model, and integrated development with other industries, then clarify specific implementation paths. Third, innovate regulatory models such as improving regulation systems, enhancing monitoring capabilities, and strengthening post−assessment to ensure regulation of far offshore wind power timely and effectively.

针对当前中国在深远海海上风电空间布局管控、管理政策、用海监管等方面存在的不足,通过分析国内外深远海海上风电用海管理现状,借鉴国外深远海海上风电项目管理经验和中国近海海域海上风电管理实践,研究提出相应对策建议:一是在查清深远海资源生态本底的基础上制定深远海海上风电空间规划,统筹推进深远海海上风电项目实施;二是探索研究深远海海上风电用海审批、开发模式、与其他行业融合发展等管理政策,明确具体实施路径;三是从完善监管制度、提升监测能力、强化后评估等方面创新监管模式,确保深远海海上风电用海监管及时有效。

In view of the deficiencies in the spatial layout control, management policies, and regulation of sea use of far offshore wind power in China currently, this paper analyses the current situation of sea management for far offshore wind power in the domestic and overseas, through drawing on the management experience of far offshore wind power from abroad and the management practice of offshore wind power in China's near−sea, the following countermeasures and suggestions are proposed: First, on the basis of clarifying the resource and ecological background of deep sea, formulate a spatial plan for far offshore wind power, and promote the implementation of far offshore wind power in a coordinated manner. Second, study on the management policies of far offshore wind power, such as approval for sea use, development model, and integrated development with other industries, then clarify specific implementation paths. Third, innovate regulatory models such as improving regulation systems, enhancing monitoring capabilities, and strengthening post−assessment to ensure regulation of far offshore wind power timely and effectively.

中国海上风能资源非常丰富,近海水深5~50 m范围内,风能资源技术开发量约5亿kW[1],深远海风能可开发量则是近海的3~4倍以上。近年来,中国海上风电装机容量持续增长,截至2023年,累计装机容量超3700 万kW[2],持续多年保持海上风电装机容量全球第一[3]。然而目前中国海上风电的开发仍以近海浅水海域为主,加上其他行业用海,导致近海海域空间资源开发利用逐步趋于饱和[45]。纵观英国、丹麦、德国等欧洲主要海洋国家当前均在大力推进深远海海上风电发展[6],欧洲开发建设的海上风电场离岸距离已达40 km以上,其中采用固定式基础的项目最大水深超过53 m,漂浮式项目最大水深超过260 m[7];在后续规划中,如英国、德国等有90%以上海上风电项目均位于深远海。因此,为适应全球海上风电产业竞争新的态势和中国沿海对清洁能源需求的不断增长,中国海上风电走向深水远岸布局是未来发展的必然趋势[89]
当前,中国深远海海上风电处于前期发展阶段,相关配套政策体系不健全,在审批流程、用海政策等方面亟待调整完善。为充分保障深远海海上风电用海需求,提高深远海海洋空间资源利用效率,全力做好海洋生态资源开发保护工作,本文重点研究深远海海上风电用海管理有关问题,并提出相应对策建议。本文所述深远海以国家“单30”政策为依据,即以海上风电场包络线与大陆海岸线最近距离大于30 km为远海风电,水深大于30 m为深海风电。
欧洲等发达国家与地区基本以“行业立法+规划+审批”对深远海海上风电项目进行管理。英国通过制定《皇家地产法》《能源法》对可再生能源项目进行管理[7,10]。丹麦通过制定《促进可再生能源法》由丹麦能源署负责管理丹麦领海基线向海200海里范围内的风电等可再生能源项目的规划和许可[11]。日本通过修订《关于促进海洋可再生能源发电设备建设相关海域利用的法律》,对海洋可再生能源发电设备进行管理。
深远海区域涉及国家内水、领海、毗连区、专属经济区和大陆架(以下简称专经)。根据《中华人民共和国海域使用管理法》(以下简称《海域使用管理法》),中国用海管理范围为内水、领海。因此,目前中国对内水、领海范围内的海上风电项目实行规划—用海论证—用海审批—用海监管的全面用海管理;而专经范围海上风电项目用海因无法适用《海域使用管理法》,故无法进行以上用海管理。
通过对比国内外深远海海上风电管理情况,并综合中国近海海域海上风电管理实践,研究认为目前中国在深远海海上风电用海管理方面还存在以下不足。
国土空间规划是各类开发保护建设活动的基本依据,海上风电应严格按照国土空间规划确定的功能区进行开发建设。胡恒、张平等[5,12]研究认为,为统筹海上风电在电力供应中的占比、配套基础设施建设、海域空间供给,应在更高层面协调、统筹沿海地区风电场规划。由于目前专经区域相关开发利用活动和生态资源底数等尚未完全掌握,一定程度上影响了该区域国土空间规划制定进程,进而导致该区域尚不能从规划层面对海上风电的选址布局进行引导规范;且部分地方海上风电规划与国土空间规划衔接不紧密,导致规划引领和管控不足,影响深远海海上风电科学布局。
一是《海域使用管理法》适用范围未包含专经,目前在该区域开展用海行政审批、授予海域使用权、开展用海监管等行为尚无法律法规予以支撑。二是随着技术迭代,风电机组单机容量逐渐增大[13],风电机组叶片、塔架和发电机等快速大型化[14],风电场规模逐步增大,其内部预留风资源缓冲恢复区间距加大,使风场内部越来越多的空间没有被实际使用,造成了海域资源的浪费。如不及时制定发布与其他行业立体复合利用相关政策,将会影响深远海海上风电有效开发,不利于深远海空间资源的可持续使用。三是在专经范围内进行海上风电开发建设,如缺乏规范的政策、公开透明的操作程序以及有效引导,可能会带来影响海洋生态与自由航行等舆论炒作风险。
深远海海上风电离岸较远,用海监管主体无法像在近岸海域一样及时有效地对监管对象进行用海监管,目前一般采用卫星遥感对用海现场进行监测分析,判断其是否存在违法行为;但考虑到卫星遥感影像分辨率只能满足疑似问题的发现,进一步核实确认具体问题仍需前往施工现场进行测量,而且卫星遥感监视的时间周期较长无法及时发现可能出现的违法用海行为。因此,针对深远海海上风电项目用海监管,必须进一步探索创新具体监管模式,以达到能够及时发现用海违法行为并予以制止。
建议加大海洋监测投入,加大监测网络建设力度,形成全方位、全功能的深远海监测体系,查清掌握生态资源现状本底,分析发展趋势。在此基础上,依据相关法律法规,统筹考虑其他用海活动,制定囊括深远海的国土空间规划,明确深远海海上风电空间规划布局。一是积极引导,形成完善的调查监测体系。应充分发挥中国体制机制优势和现有调查监测能力,前期调查应以国家力量为主、地方力量为辅,尽快掌握深远海需要开发建设海域的空间生态资源本底,为加快推进深远海海上风电建设提供要素支撑;同时,在调查实践中提升国家深远海调查监测能力,壮大调查监测力量。后续可根据需要,在国家力量统筹指导下,深远海调查监测逐步向地方和社会市场开放,形成比较完善的国家、地方、社会三层调查监测体系。二是加强管理,构建完整的空间利用和生态资源数据库。国家应加强对深远海海洋空间利用和生态资源数据的统一管理,形成全国海域空间利用现状图、生态资源底数现状分布图和趋势图,进而形成国土空间规划“一张图”,为后续深远海海上风电等开发利用活动做好相关数据支撑保障。三是根据深远海空间利用现状和生态资源状况,以生态保护红线管控及资源环境底线约束为基础,通过分析海上风能等资源环境禀赋、研判国土空间开发利用风险与问题[15],结合海上风电项目建设经济性等方面情况,充分排查并考虑军事、交通、海事、渔业、环境等冲突性、敏感性因素,从而确定空间开发的最大规模与适宜程度,进而形成可开发场址[6]。四是加强深远海海上风电规划布局顶层设计,借鉴欧洲等发达国家在深远海布局海上风电的成功经验,以“化零为整、立体开发”的理念,统筹推进全国深远海海上风电场址集中连片规划,推进海上风电集中布置、规模布局[1617],形成具有较强影响力的海上风电产业集群发展模式。五是加强深远海海上风电国土空间规划的论证、评审,综合平衡各方利益和统筹考虑各种因素,确保规划的科学性、合理性和可操作性。同时,要强化规划的严肃性和约束性,经严格论证、评审并经批准后的规划是深远海海上风电项目布局的规划纲领,不能随意更改。
根据深远海海上风电发展需求,结合当前存在的问题,有针对性地开展先行先试,在总结试点经验的基础上研究形成深远海海上风电用海管理政策并固化为制度。一是加快明确专经范围海上风电用海管理方式。建议借鉴英国等对海上风电实施的大陆架海床管理的相关实践经验,依据《中华人民共和国专属经济区和大陆架法》,从中国对大陆架行使开发自然资源主权权利的角度出发,探索海上风电桩基、锚链、海底电缆管道等利用大陆架海床空间资源的适用政策,研究大陆架海上风电空间资源利用管理工作并形成相关制度规则。同时,也可先行探索在专经对海上风电项目用海实行用海审批,但不授予海域使用权的尝试,从行政审批角度做到对专经海上风电的用海管理。二是探索对深远海集中连片布局的海上风电实行集中审批、集中管理,降低企业前期投入成本和缩短审批时间。分2种情形考虑:(1) 由政府协调,确定一家企业作为项目用海单位牵头办理集中连片海上风电场、输电电缆通道、登陆点的用海审批,再根据规划和相关协议,将部分海域通过转让或租赁的方式转给其他用海单位,分区块共同开发;(2) 由政府牵头完成集中连片海上风电场、输电电缆通道、登陆点的用海论证、审批工作,再通过市场化出让的方式分区块确定用海主体,进行共同开发。三是加强海域节约集约利用,提高海域利用效率。对集中连片海上风电场要统一规划、统一设计,尽量共用海上升压站、海底电缆等配套设施;同时,加强深远海海上风电与其他项目的耦合论证,预留其他项目发展空间,或与其他项目一并申报,充分利用风电场内部空间,切实做到一海多用,提高海域空间资源利用效率[18]。(1) 探索与海洋能、制氢、储能等电源系统融合发展[19],打造集成能源电力枢纽、制氢储运加用等一体的深远海一体化能源岛;(2) 探索与海洋牧场融合立体开发,构建“绿色能源+蓝色粮仓”业态融合开发新模式;(3) 探索与海洋油气田开采融合发展,形成海上风电与油气田区域电力系统互补供电模式。四是遵守国际规则,加强深远海海上风电用海管理。制定深远海用海管理政策,尤其涉及专属经济区和大陆架区域时,需充分考虑该区域的特殊性,应严格遵从《联合国海洋法公约》《中华人民共和国专属经济区和大陆架法》等法律法规;制定政策后,应及时发布并做好解读,积极引导正确舆论。同时,在专经布局海上风电项目时,应确保项目选址范围完全无争议,提前发布环境影响评价、通航影响评估等报告,并在国际合作中强调风电的全球减排贡献[20]
深远海海上风电用海监管应从完善宏观政策予以保障和具体操作层面加以协调进行共同发力。一是宏观政策层面,建议从监管要求、监管主体、监管内容、监管形式、监管效果等方面进一步全流程梳理深远海海上风电用海监管工作,查漏补缺,进一步完善相关监管制度体系,尤其是要强化监管效果的体现。二是具体操作层面。(1) 依托现有观测设施,并利用深远海海上风电、油气平台、海洋牧场等加装相关监测设施,构建“空、天、地、海”一体化覆盖深远海的监控体系,提高深远海海上实时监测水平,提升海上违法目标主动发现和识别能力。(2) 加强教育、引导,充分发挥用海单位的主观能动性,切实提高其合法合规用海的责任意识,项目建设严格按照规划、用海批复要求进行,并主动让监管主体进入工程建设工作组,每日通报工程信息,使监管主体及时掌握工程建设进展、用海和生态影响等情况,有效遏制违法用海倾向和消除可能出现的违法用海行为。(3) 要提高深远海海上风电违法用海成本,尽量降低用海单位的主观违法用海意识。三是做好深远海海上风电用海生态跟踪监测和后续评估。(1) 应根据有关政策、要求,继续加强对深远海海上风电施工期和运营期的生态跟踪监测,确保能够及时掌握项目对周边海域海岛生态影响情况。(2) 建议抓紧建立深远海海上风电对生态资源影响的评价标准和评估体系,为后续深远海海上风电项目用海管理提供科学依据。
通过对比国内外深远海海上风电管理情况,并综合中国近海海域海上风电管理实践,研究认为目前中国在深远海海上风电用海管理方面主要存在以下3方面问题。一是规划引领与管控不足,部分地方海上风电规划与国土空间规划衔接不紧密,专经资源调查不足,影响深远海风电科学布局。二是用海管理政策不明确,《海域使用管理法》无法覆盖专经,深远海海上风电用海审批缺乏法律依据;风电机组大型化导致海域排他性浪费愈加严重,立体复合利用政策尚缺失,造成海域资源利用极不充分。三是监管模式不够创新,深远海风电远离大陆,传统卫星遥感+船舶巡查方式效率低,难以及时发现和制止违法用海行为。
对此,按照“空间摸底—规划前置—审批适配—立体监管”的深远海用海管理闭环框架,本研究提出用海管理对策措施。一是加强调查与规划引领,加大深远海生态资源调查,建立“国家−地方−社会”三级监测体系,整合生态资源数据库与空间利用需求,形成国土空间规划“一张图”,科学引导风电布局。二是完善用海管理政策,研究专经风电用海管理制度,提出“审批不授权”的过渡性管理方案,探索海上风电桩基、锚链、海底电缆管道等利用大陆架海床空间资源的适用政策,构建“主权权利行使”与“海域使用权”分离的新型模式;提出“政府主导+市场化运作”的集中审批双轨制,创新立体开发模式。三是创新监管模式,利用风电设施本身作为监测节点实现递归式覆盖,构建“空天地海”一体化监测体系;建立工程信息通报与监管嵌入式工作组的实时反馈机制;创建深远海海上风电生态资源影响评价指标体系,填补国内外标准空白,推进可持续发展。通过对上述问题和对策措施的研究分析,认为深远海海上风电在强化规划顶层设计,创新审批模式,构建“空天地海”一体化监测体系,引入企业自律和实时通报机制等方面对中国加强深远海海上风电用海管理具有十分重要的借鉴和研究意义。下一步,建议要进一步统筹规划、政策、监管全链条管理,推动深远海风电向集约化、集群化发展,并兼顾经济效益、社会效益与生态保护,助力“海洋强国”战略实施。
