In response to the problems of unclear and insufficient connection paths and depth between urban rail transit industry planning environmental impact assessment (EIA), project EIA, environmental acceptance, law enforcement supervision, and regional ecological environment zoning control (zoning control), this study summarizes the characteristics and key contents of rail transit planning EIA and project EIA. Referring to the linkage requirements of rail transit planning EIA and project EIA, the connotation of listbased management is analyzed, and the feasibility of implementing listbased environmental management in the rail transit industry was analyzed. Lists for zoning control, planning EIA, project EIA, environmental acceptance, and law enforcement supervision are developed. The connection paths and methods for listbased environmental management in the rail transit industry are proposed. Research has shown that inventory management is an important measure for improving environmental management in the rail transit industry and has the conditions for implementation. The zoning control, planning EIA, project EIA, environmental protection acceptance, and law enforcement inspection checklists transmit different management requirements from front to back, while providing feedback on different management effectiveness information from back to front. Through different management lists, the approval department, planning department, construction unit, evaluation unit, and law enforcement department can identify key points that their respective departments and units should focus on, implement environmental access and environmental protection measure requirements, and provide technical paths and methods for promoting comprehensive environmental management of the rail transit industry.

针对城市轨道交通行业规划环评、项目环评、环保验收、执法监管以及与区域生态环境分区管控(以下简称分区管控)之间衔接路径不够明确、衔接深度不足等问题,总结轨道交通特点和规划环评、项目环评重点内容,参考轨道交通规划环评与项目环评的联动要求,解析清单式管理的內涵,分析轨道交通行业实施清单式环境管理的可行性,研究制定分区管控、规划环评、项目环评、环保验收、执法督察清单,提出轨道交通行业清单式环境管理的衔接路径和方法。研究表明:清单式管理是健全轨道交通行业环境管理的重要举措,具备实施的条件;分区管控、规划环评、项目环评、环保验收、执法督察清单自前向后传递不同管理要求,自后向前反馈不同的管理有效性信息;审批部门、规划部门、建设单位、评估单位和执法部门等通过不同的管理清单,了解本部门本单位应关注的重点,落实环境准入和环保措施要求,为推动轨道交通行业全过程环境管理提供了技术路径和方式方法。

针对城市轨道交通行业规划环评、项目环评、环保验收、执法监管以及与区域生态环境分区管控(以下简称分区管控)之间衔接路径不够明确、衔接深度不足等问题,总结轨道交通特点和规划环评、项目环评重点内容,参考轨道交通规划环评与项目环评的联动要求,解析清单式管理的內涵,分析轨道交通行业实施清单式环境管理的可行性,研究制定分区管控、规划环评、项目环评、环保验收、执法督察清单,提出轨道交通行业清单式环境管理的衔接路径和方法。研究表明:清单式管理是健全轨道交通行业环境管理的重要举措,具备实施的条件;分区管控、规划环评、项目环评、环保验收、执法督察清单自前向后传递不同管理要求,自后向前反馈不同的管理有效性信息;审批部门、规划部门、建设单位、评估单位和执法部门等通过不同的管理清单,了解本部门本单位应关注的重点,落实环境准入和环保措施要求,为推动轨道交通行业全过程环境管理提供了技术路径和方式方法。

In response to the problems of unclear and insufficient connection paths and depth between urban rail transit industry planning environmental impact assessment (EIA), project EIA, environmental acceptance, law enforcement supervision, and regional ecological environment zoning control (zoning control), this study summarizes the characteristics and key contents of rail transit planning EIA and project EIA. Referring to the linkage requirements of rail transit planning EIA and project EIA, the connotation of listbased management is analyzed, and the feasibility of implementing listbased environmental management in the rail transit industry was analyzed. Lists for zoning control, planning EIA, project EIA, environmental acceptance, and law enforcement supervision are developed. The connection paths and methods for listbased environmental management in the rail transit industry are proposed. Research has shown that inventory management is an important measure for improving environmental management in the rail transit industry and has the conditions for implementation. The zoning control, planning EIA, project EIA, environmental protection acceptance, and law enforcement inspection checklists transmit different management requirements from front to back, while providing feedback on different management effectiveness information from back to front. Through different management lists, the approval department, planning department, construction unit, evaluation unit, and law enforcement department can identify key points that their respective departments and units should focus on, implement environmental access and environmental protection measure requirements, and provide technical paths and methods for promoting comprehensive environmental management of the rail transit industry.

“十四五”时期,我国正进一步健全生态环境分区管控(以下简称分区管控)-规划环评-项目环评-排污许可-环境执法-督察问责 “六位一体” 的环境管理体系 [ 1 ] , 发挥制度合力。一些专家学者针对规划环评与项目环评 [ 2 - 4 ] 、环评与分区管控 [ 5 - 8 ] 、环评与排污许可 [ 9 - 13 ] 等制度之间的衔接联动开展了一系列研究。总体来看, 研究制度衔接机制和内容的较多, 针对衔接路径和方法的偏少。为进一步深化环评改革, 优化制度流程, 发挥制度效能, 亟须创新衔接模式, 明确衔接路径, 简化制度串联方式。清单式环境管理就是把各阶段、各环节的环境管理要求、公示材料、技术文件等分块分条, 细化量化, 通过清单形成一清单公示一清单审核一清单执法一清单反馈, 形成责任边界清晰、各类事项明确、制度前后联动的管理清单 [ 14 ] 。实践中,分区管控要求制定生态环境准入清单, 产业园区规划环评开展了清单管理试点, 新修订的建设项目环评导则总纲分污染影响类和生态影响类项目,分别制定了污染物排放基础信息表、生态环境保护措施监督检查基础信息表, 地方生态环境部门编制了排污许可执法清单。这些举措为项目全链条清单式管理积累了经验, 但还不够系统, 制度间缺乏清晰具体的衔接路径, 需要针对行业特点,开展行业环境管理的清单式衔接联动研究。
轨道交通规划环评与项目环评联动的研究很少。 韩沙沙 从线网规模、线网结构、环境保护目标、线网优化等方面简析了轨道交通规划环评与项目环评的区别。政策规范方面,《关于做好城市轨道交通项目环境影响评价工作的通知》(环办 ( 2014 ) 117 号)提出, 规划环评审查意见是相关项目环评受理审批的依据, 项目要落实规划环评要求。《加强规划环境影响评价与建设项目环境影响评价联动工作的意见》(环发 ( 2015 ) 178 号)将轨道交通纳入开展规划环评与项目环评联动的 5 个领域之一, 明确了规划环评和项目环评各自的重点, 规划环评要论证线网规模、布局、敷设方式和重要场站的环境合理性, 提出选址选线避让环境敏感区、环境保护目标等要求, 明确生态环境保护措施; 项目环评要落实规划环评结论及审查意见要求, 并根据规划环评内容适当简化。《环境影响评价技术导则城市轨道交通》(HJ 453- 2018 )要求,项目环评应分析工程与规划方案变化情况和审查意见落实情况。实际工作中, 轨道交通项目环评落实规划环评审查意见方面执行较好, 但对于项目环评的简化、项目环评信息反馈等方面的内容执行不够。综上可见, 涉及轨道交通规划环评与项目环评衔接联动的具体路径、方式方法等方面的研究实践不多, 特别是环评与分区管控、执法监管等方面的衔接联动欠缺。
轨道交通规划一般包括线网规划和近期建设规划。其中, 线网规划比较宏观, 一般说明规划的线位、 站数、辐射范围等; 近期建设规划相对具体, 在线路走向、车型, 以及线路与环境敏感区的总体位置关系较明确。规划环评应重点关注线路、车辆基地等工程占用环境敏感区或线路穿越地下饮用水水源保护区、 重要泉域, 以及下穿学校、医院、文物保护单位、集中居住区等噪声振动敏感点, 论证规划线路及相关工程选址选线、敷设方式、车辆选型、运行速度等的环境合理性, 并据此提出优化调整建议。涉及减缓环境影响的具体措施, 一般由项目环评解决。
在项目可研阶段, 线路的走向、敷设方式、埋深, 车辆基地、风亭、冷却塔、变电站等工程的位置、敷设方式, 出入场(段)线的曲线半径、轨道结构, 以及各工程涉及的环境保护目标数量、相对位置关系等都应明确具体,项目环评应重点关注项目运行可能产生的环境影响,特别是对距离外轨中心线 ${50}\mathrm{\;m}$ 范围内 (尤其是线路正下穿)及风亭、冷却塔、变电站和包含试车线的车辆基地评价范围内环境保护目标的影响, 并根据评价结果和公众参与情况进一步优化局部线路走向、敷设方式、埋深, 以及有关工程的选址、埋深、 景观设计等 [ 16 ] ,提出减振降噪止水纳污等措施,以及环境监测计划监管内容。
清单式管理要求每个环节形成 1 个产出清单, 前一环节清单要考虑后一环节管理需求, 后一环节清单反馈前一环节管理要求落实情况及存在的问题, 并以各阶段清单要求为主线进行串联 [ 16 ] 。实行清单式环境管理,有助于聚焦各制度重点、厘清各方责任、落实生态环境保护要求, 可以避免制度间叠床架屋或出现管理盲区的现象。
一是便于全过程监管。利用制度间自上而下传递、 自下而上反馈, 可实现环评、验收和执法全过程协同监管。二是聚焦监管重点。将环评文件分为技术报告和成果清单, 评估中重点审核技术报告的科学性, 审批中重点审查成果清单之管理要求的可操作性, 环评公示材料仅限成果清单, 相关技术报告可依申请公开。 这种方式既有助于解决环评落实不到位问题, 也能减少大数据时代全信息公开可能带来的安全隐患和舆情风险。三是厘清各方责任。审批部门、评估机构、建设单位、执法部门等关注不同的清单任务和要求。轨道交通是推进城市交通绿色低碳发展的重要途径, 环境可持续是轨道交通可持续发展的重要组成部分。随着美丽中国建设的新质生产力的发展, 有必要通过创新优化轨道交通环境管理制度衔接方式, 聚焦其环境影响特点, 优化选址选线、施工工艺和减振降噪设施性能等, 从源头进一步降低环境影响, 同时降低环境管理成本。
一是实施清单式管理具有较好的理论基础。轨道交通领域制定了《地铁设计规范》《市域(郊)铁路设计规范》《市域轨道交通设计标准》等行业规范,其规划、 可研体系较完整;制定了行业环评管理、审批原则和技术规范。环评管理和技术体系较成熟, 同时其影响源、影响路径和影响受体都比较明确。二是对分区管控提出了原则性要求。我国省、市 2 级完成了分区管控编制, 涉及轨道交通规划的城市一般对线路走向、敷设方式等提出了原则性要求。三是清单式管理有现成的技术规范支持。现行的环境影响报告表编制技术指南和正在修订的建设项目环评导则总纲均要求, 生态影响类项目环评应附具监督检查信息表。四是清单式管理已有一定的现实基础。环评中一般列表描述工程涉及的环境保护目标、噪声振动影响预测及相应的减缓措施, 一些生态影响类建设项目中运用清单式表格进行监管, 收效明显。
行业管理清单包括两部分, 一是各项制度本身的成果清单, 属于该项制度清单主体内容, 涉及清单的编制、公开、评估、审批和监管环节;二是制度间的衔接清单, 属于制度清单的辅助内容, 涉及项目的传导和反馈环节。
管理清单类型多样。就形式而言, 可分为台账式、 检查表式、总结式和可追溯式。就清单行使主体而言, 可分为权力清单和责任清单。就清单性质而言, 可分为正面清单和负面清单 [ 14 ] 。环境管理中的清单大体上分为 3 类, 一是空间维度导向的清单, 如分区管控中从空间布局、污染物排放、资源利用和环境风险防范等 4 个维度提出准入要求; 二是环境要素导向的清单, 如项目环评附具的信息表中从水、气、土、生态等环境要素提出衔接排污许可或环境执法的要求。三是环境问题导向的清单, 执法督察清单中, 往往要明确区域或企业存在的环境问题, 并提出整改意见。清单式管理常见方法就是图表式, 以表格清单为主, 直接点明问题,明确整改措施,给出准入要求。
分区管控中涉及轨道交通环境准入的内容较少, 一般在 “空间布局约束” 中可能对轨道交通的选址选线和敷设方式提出要求, 如避让环境敏感区、中心城区采用地下敷设方式等。
规划环评重点是线位走向、敷设方式、工程设施选址等,一般包括规划内容、环境敏感区、现状环境问题、环境影响预测评价、规划方案优化调整建议、 生态环境保护措施、规划环境影响跟踪评价(以下简称跟踪评价)、规划环评和项目环评联动等 8 张清单, 各清单内容如 表 1 所示。跟踪评价清单可参考规划环评清单, 重点围绕规划实施情况制定。
项目环评重点是环境影响预测评价和减缓措施,一般包括项目概况、分区管控和规划环评落实情况、环境保护目标、环境影响预测评价、公众意见调查与采纳、生态环境保护措施、环保验收与执法监管建议等 7 张清单, 各清单内容如 表 2 所示。
环保验收重点是工程的实际环境影响、保护措施及公众意见,一般包括项目建设内容、环境问题和公众意见、生态环境保护措施和执法监管等 4 张清单, 各清单内容如 表 3 所示。
环境执法重点关注工程建设运行中存在的主要环境问题, 一般包括各类要求落实、“未批先建” 与重大变动、重点关注路段和工程、主要环境问题及整改建议等 4 张清单, 环保督察清单与执法清单内容相似, 各清单内容如 表 4 所示。
轨道交通行业涉及的几项环境管理制度清单重点内容不同,传递和反馈的关键信息也多有不同。如 图 1 所示, 制度衔接大致有 5 条路径, 构成了环境管理体系衔接联动的主线。
路径 1: 分区管控清单传递轨道交通建设总体性环境管理要求。信息传递方向主要有 2 个: 一是将线路走向、敷设方式等总体要求和区域环境敏感区信息传递给规划环评, 指导轨道交通规划布局; 二是将线路走向、敷设方式等总体要求传递给项目环评。规划环评、项目环评应比照分区管控清单, 落实相关总体要求, 对于明显不符合分区管控要求的规划或项目, 其环评应提出合理的优化调整建议。由于轨道交通项目环评基本都有规划环评支撑, 故分区管控传递给项目环评的信息有限。
路径 2: 规划环评清单传递规划布局、规模和敷设方式等方面的准入要求。信息主要传递方向 3 个、反馈方向 1 个:①将线路的走向、长度、敷设方式、重要保护目标, 以及不同车速车型下的振动、噪声源强等传递给项目环评, 并明确不同线路应重点论证和简化评价的要求;②将规划布局、规模、敷设方式, 公众意见, 以及规划优化调整建议、环保措施等传递给跟踪评价;③将规划环评及其审查意见要求传递给执法督察。规划环评审查重点是清单的合理性和可操作性, 跟踪评价审核重点是清单的准确性和合理性, 规划环评和跟踪评价准入要求及时反馈至分区管控。项目环评应严格落实规划环评要求, 进一步优化工程建设, 减轻环境影响。跟踪评价应分析规划环境影响预测的准确性、环保措施的有效性, 并将尚未实施的规划优化调整建议和强化的保护措施信息传递给执法督察。
路径 3: 项目环评清单传递工程建设、主要环境影响及减缓措施等方面的要求。信息传递方向主要有 2 个: ①将线路长度、走向、敷设方式、站场设置、主要环境保护目标、环保措施等传递给环保验收, 作为验收的重点内容;②将减振降噪设施及其他环保措施要求传递给执法督察, 作为检查的内容之一。项目环评审批中, 重点审查清单的科学性和可操作性, 确保环评提出的环保措施可以落地。
路径 4: 环保验收传递项目主要问题、环保措施建设运行情况等方面的信息。信息主要传递方向 1 个、 反馈方向 2 个。将项目现有环境问题、环境管理要求、 执法监管建议等传递给执法督察, 将环境影响预测的准确性、环保措施的科学性等反馈给项目环评,将沿线公众环保投诉、项目存在的主要环境问题等反馈给规划环评及其跟踪评价。生态环境部门应加强环保自验收质量抽查, 重点抽查项目变动情况、问题描述的客观性和环保措施的可行性。
路径 5: 执法督察反馈主要环境问题及整改建议等方面的信息。信息主要反馈方向是规划环评和跟踪评价, 在现行跟踪评价或下一轮规划环评中, 及时了解已运行的线路存在的生态环境问题和整改要求。
完善的管理和技术体系为轨道交通行业清单式管理奠定了基础。轨道交通行业有专门的设计规范, 有明确的规划和可研编制要求, 有行业规划环评技术要点、项目环评技术导则和审批原则等。各项制度间的重点内容界限较清晰, 规划环评对项目环评的指导性强, 项目环评对环保验收和监督执法的参照性强, 这些特点有助于形成体现各项制度特点和衔接要求的清单。同时, 清单式管理为深化轨道交通行业环评改革提供了方法。轨道交通行业管理清单体系通过制度间自前向后的管控指导和自后向前的信息反馈, 构建了制度衔接主线, 推动制度间互动, 既减少重复评价, 又加强制度间的互补, 避免形成管理空白, 推动轨道交通项目前端优布局、中端强措施、末端严执法, 形成了衔接紧密的全过程环境监管体系。为有效推动轨道交通清单式管理, 提高清单式管理的科学性, 建议加强相关方面研究实践。
1) 试点开展轨道交通行业清单式环境管理。选取轨道交通发达的城市, 针对线路走向、敷设方式、埋深、车辆基地选址, 以及线路和工程与敏感点距离都比较明确的规划, 试点开展规划环评清单式管理; 选取规划中研究深度较好的线路, 试点开展项目环评清单式管理; 结合规划环评和项目环评信息, 选取基础条件较好的线路, 试点开展环境执法清单式管理。考虑轨道交通建设周期较长,可暂不试点开展环保验收清单式管理。
2) 研究制定轨道交通环境管理标准化清单。结合轨道交通清单式环境管理试点成果, 制定规划环评、 项目环评和环境执法标准化清单, 推动清单制式化或智能化, 各相关部门或单位可根据其职能关注不同的清单, 审批部门严审环境准入清单, 规划部门聚焦优化调整清单, 建设单位主要落实环保措施清单, 评估单位重点审查清单技术支撑的科学性, 环境执法部门重点关注环境问题及整改要求清单, 规划单位和建设单位同时要落实执法部门提出的环境整改清单。
